Service Terms

OrangeWidow Service Terms & Conditions

These Service Terms govern your purchase and use of OrangeWidow hosting and web development services. By placing an order, you agree to these terms.

1. Service Provision

1.1 Managed Hosting: We provide managed hosting on our AlmaLinux infrastructure. All hosting plans include email services, database access, and control panel access via DirectAdmin.

1.2 Web Development: Bespoke development projects are quoted individually with defined deliverables, timelines, and payment terms outlined in separate project agreements.

2. Acceptable Use Policy

Our services may not be used for:

  • Illegal activities or content prohibited by UK law
  • Spam, phishing, or malware distribution
  • Resource abuse affecting other users (excessive CPU, memory, or bandwidth)
  • Copyright infringement or pirated content
  • Cryptocurrency mining without explicit authorisation
  • Tor exit nodes or proxy services for illegal activities

Violations may result in immediate service suspension without refund.

3. Payment Terms

3.1 Billing: Services are billed in advance on monthly, quarterly, or annual cycles. Invoices are issued 7 days before the due date.

3.2 Late Payments: Services may be suspended after 7 days overdue. Data may be permanently deleted after 30 days overdue.

3.3 Price Changes: We reserve the right to adjust pricing with 30 days notice for renewals. Existing service periods are not affected.

4. Refund Policy

4.1 Hosting: Refunds are provided at our discretion on a case-by-case basis. Setup fees are non-refundable.

4.2 Development: Bespoke development deposits are non-refundable. Milestone payments are due upon completion of agreed deliverables.

5. Service Level Agreement (SLA)

5.1 Uptime: We target 99.9% monthly uptime for hosting services. Excludes scheduled maintenance and circumstances beyond our control.

5.2 Backups: We perform daily backups retained for 7 days. Customers are responsible for maintaining their own backups.

5.3 Support: Technical support is available via ticket system with response targets of 4 hours (business hours) and 24 hours (out of hours).

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorised access. We are not liable for losses resulting from your failure to secure your account.

7. Termination

Either party may terminate services with 30 days written notice. Upon termination, you are responsible for backing up and migrating your data. We may delete data 30 days after service termination.

8. Limitation of Liability

Our liability is limited to the amount paid for the service in the 12 months preceding the claim. We are not liable for indirect, consequential, or loss of business damages.

9. Data Protection

We process personal data in accordance with UK GDPR. Our Data Processing Agreement is available upon request for business customers.

10. Governing Law

These terms are governed by the laws of England and Wales. Disputes shall be resolved through the courts of England and Wales.
